Embratel is preparing to appeal to the Supreme Court (STF) in its legal battle to prevent Telefonica from offering fixed-line residential subscribers in São Paulo State long-distance service to the rest of Brazil, says Pedro Martins, the incumbent long-distance carrier?s chief counsel. ?Both the extension to Telefonica?s local license and the authorization granted provisionally by Anatel allowing the LEC to offer domestic long-distance service are unconstitutional. We will fight this through the courts for as long as it takes, even if we have to appeal to the Supreme Court,? he says. As Brazil?s highest court of appeal, the STF hears only cases involving allegations of unconstitutionality.
